Terms & Conditions of Hire

By making a booking with Pull Up VIP, the hirer acknowledges and agrees to the following Terms and Conditions. These terms are governed by the applicable laws and regulations of THE AREA OF HIRE and are designed to ensure safety, compliance and a high standard of service.

1. BOOKING CONFIRMATION

All bookings with Pull Up VIP are subject to availability and are only confirmed once a non-refundable deposit has been received.

A 15% deposit is required within 24 hours of the invoice being issued. If payment is not received within this timeframe and no communication has been made, Pull Up VIP reserves the right to release the booking.

The deposit is 15% of the total invoice (not including the security bond). The deposit will be deducted from the total.

Bookings are not secured until the deposit has cleared and confirmation has been provided.


2. SECURITY BOND

A refundable security bond between $100 and $300 is required for all bookings. The bond amount will be determined by Pull Up VIP based on the booking type, duration, passenger group and overall risk assessment of the hire.

The security bond is payable prior to the commencement of the hire and is held as protection against damage, excessive cleaning, breaches of these Terms and Conditions or any additional costs incurred.

The bond will be refunded after the completion of the hire, subject to inspection of the vehicle and confirmation that all conditions have been met.

Pull Up VIP reserves the right to retain part or all of the bond where necessary. If costs exceed the bond amount, the hirer agrees to pay the outstanding balance. If not, we may take reasonable steps to recover the excess amount.


3. PAYMENTS

Full payment of the total hire cost must be finalised no later than 14 days prior to the booking date unless otherwise agreed in writing.

Accepted payment methods include bank transfer and credit/bank card.

Failure to make payment by the due date may result in cancellation of the booking and forfeiture of any amounts paid.

All invoices must be paid in full prior to the commencement of the hire.


4. CANCELLATIONS AND RESCHEDULING

All deposits are non-refundable.

In the event of cancellation:

  • More than 7 days notice: deposit is forfeited
  • Within 7 days: 50 percent of the total booking cost is payable
  • Within 24 hours: 100 percent of the total booking cost is payable
  • Cancellation after vehicle dispatch or arrival: full hire fee is payable

At the discretion of Pull Up VIP, bookings may be rescheduled once within six months of the original date. Additional changes may result in forfeiture of payments.


5. PASSENGER BEHAVIOUR AND CONDUCT

Pull Up VIP is committed to providing a safe environment for passengers and staff.

Passengers must not engage in behaviour that is unsafe, unlawful, aggressive, abusive or disruptive.

The driver has full authority to refuse entry or direct any passenger to leave the vehicle if their behaviour is considered inappropriate or poses a risk to safety.

This includes but is not limited to:

  • Aggressive or abusive conduct
  • Physical altercations
  • Damage to property
  • Interference with the driver
  • Excessive intoxication

No refunds will be provided where passengers are removed or where the service is terminated due to misconduct.


6. INTOXICATION

Passengers who are deemed by the driver to be excessively intoxicated or unfit for travel may be refused boarding or removed from the vehicle at any time.

Any such passenger will be responsible for arranging alternative transport at their own expense.

Pull Up VIP prioritises safety and compliance at all times and supports the driver’s discretion in these matters.


7. DAMAGE, CLEANING AND LIABILITY

The hirer is fully responsible for the conduct of all passengers and any damage caused during the hire period.

The security bond may be retained in part or full where:

  • The vehicle is left in an unsatisfactory condition
  • Excessive cleaning is required
  • Any damage occurs to the vehicle, fittings or equipment
  • Safety features are misused or tampered with
  • The driver is significantly distracted or placed at risk

Pull Up VIP reserves the right to recover all costs associated with repairs, cleaning, downtime or third-party damage.

Where damage is caused to public or private property, Pull Up VIP may provide the hirer’s details to relevant parties or authorities.


8. SAFETY AND VEHICLE RULES

Passengers must comply with all safety instructions provided by the driver at all times.

Seatbelts must be worn where fitted.

Standing or moving within the vehicle is undertaken at the passenger’s own risk.

Any unsafe behaviour, including standing on seats, interfering with fittings or obstructing access points, is strictly prohibited.

Pull Up VIP accepts no liability for injury resulting from failure to follow safety instructions.


9. CCTV AND SURVEILLANCE

All Pull Up VIP vehicles are equipped with CCTV and audio recording systems for safety and compliance purposes.

By boarding the vehicle, passengers consent to being recorded.

Footage may be used in the event of incidents, disputes or legal proceedings and remains the property of Pull Up VIP.


10. HIRER RESPONSIBILITIES

The hirer is responsible for:

  • Ensuring all passengers comply with these Terms and Conditions
  • Communicating all relevant information to their group
  • Managing passenger behaviour throughout the hire

A responsible lead passenger must be nominated and must assist the driver where required, including ensuring all passengers are accounted for at each stop.

Failure to manage the group appropriately may result in termination of the service without refund.


11. TIMING, DELAYS AND OVERTIME

All bookings operate on strict time allocations.

Passengers must be ready at the agreed pickup time. A grace period of 15 minutes may apply, after which Pull Up VIP reserves the right to depart or apply additional waiting charges.

Overtime may be charged at applicable rates where services extend beyond the agreed booking period.

Pull Up VIP is not responsible for delays caused by passengers, traffic conditions, weather, roadworks or other unforeseen circumstances.


12. ROUTE, ITINERARY AND LOCATION CHANGES

All pick up locations and destinations must be confirmed prior to the booking.

Requests for changes must be made at least 7 days in advance and are subject to approval.

Changes on the day may not be accommodated and may incur additional charges.

Certain locations may have restrictions on pickup and drop-off due to council or transport regulations. In such cases, the nearest safe and legal location will be used.


13. VEHICLE ALLOCATION

While every effort is made to provide the requested vehicle, Pull Up VIP reserves the right to substitute a similar vehicle where required due to operational needs, maintenance or unforeseen circumstances.

No refund will be provided in such cases provided a comparable service is delivered.


14. VENUES AND THIRD PARTIES

Pull Up VIP is not responsible for entry refusal to venues for any reason.

Passengers must comply with all venue requirements including identification, behaviour and dress standards.

No refunds or compensation will be provided where access to venues is denied.


15. BREAKDOWNS AND SERVICE INTERRUPTIONS

In the event of a mechanical issue or unforeseen disruption, Pull Up VIP will make reasonable efforts to provide an alternative vehicle or solution.

However, no guarantee is made regarding exact timing or continuity of service.

Compensation, if any, will be assessed at the sole discretion of Pull Up VIP.


16. LIABILITY AND INDEMNITY

To the maximum extent permitted by law, Pull Up VIP is not liable for:

  • Loss or damage to personal property
  • Injury sustained due to passenger behaviour
  • Delays outside of our control
  • Actions of third parties

The hirer agrees to compensate Pull Up VIP against any claims arising from the actions of their group.


17. LOST PROPERTY

All personal items remain the responsibility of passengers.

Pull Up VIP accepts no responsibility for lost or damaged belongings.

Any items left on board should be reported promptly, and while reasonable efforts will be made to assist, retrieval is not guaranteed.
